A NEW Zealander man who was jailed over a brutal attack on his girlfriend is allowed to stay in Australia after a tribunal overrode the Federal Government efforts to deport him.

Frank Matiu, who played for the New Zealand All Blacks under-21 team before emigrating to Australia, was drunk and had taken drugs when he punched, choked and bit his screaming girlfriend before forcing her to eat sleeping tablets, reports the Herald Sun.

Immigration Minister Chris Bowen withdrew the 46-year-old's visa after he was jailed for almost five years over the attack on a Melbourne woman in a Reservoir shed. Administrative Appeals Tribunal member John Handley overturned the decision last week despite labelling the crime ‘especially brutal’ as well as ‘abhorrent’.

The tribunal heard Matiu has a long history of offending, concluding in the 2009 attack that netted him the long stint in Beechworth Prison. Matiu had been with a group that had been drinking and smoking marijuana in Melbourne, before setting upon his girlfriend in a jealous rage in the nearby shed where they lived.

County Court Judge Michael Tinney said to Maitu that he called her a ‘slut’ and started punching her in the face without any warning.
